Distributor Program Policies

III. Products and Services Policies

In the event a Distributor's Dealer is authorized to sell the following brands, products, or services, the following obligations shall apply. Distributor shall only enforce this policy in its and its Dealer's Territories to the extent legally permitted.

• A. SunBriteTV
  1. SunBriteTV Third-party Marketplace Policy.
     1. SunBriteTV, LLC (“SunBriteTV “) is a wholly-owned subsidiary of ADI. Authorized dealers of SunBrightTV may not sell SunBriteTV-branded products through online third-party marketplaces, including but not limited to, Amazon.com and ebay.com.
     2. This policy does not apply to non-marketplace websites that are owned and operated by authorized SunBriteTV resellers.
     3. Recertified/refurbished products may be sold on third-party marketplaces; however, this must be clearly stated in the advertisement. At all points in the promotional process, the terms “recertified” or “reconditioned unit” must be included with the model number and price.
     4. Failure to abide by this policy will result in termination of dealership or distributorship. SunBriteTV is not required to provide prior notice or issue warnings before taking action under this policy.
